What is POSH law?

POSH law is Prevention of Sexual Harassment. It is a comprehensive legislation that makes it mandatory for every employer to provide a safe, secure and healthy work environment, free from sexual harassment to every woman. Sexual harassment violates the fundamental rights of a woman to gender equality and right to life and liberty and right to work with human dignity guaranteed under the Articles 14, 15 and 21 of the Constitution of India.

What is Sexual Harassment Act, 2013?

The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, is a remarkable piece of legislation that declares sexual harassment of women illegal. Implemented from December 9, 2013 this Act is applicable on every organization having more than 10 employees and extends to the entire length and breadth of the country. This Act covers a wide range of action and behavior, irrespective whether directly or by implication, in the ambit of “sexual behavior” and there have been quite a few cases in which high profile people have been accused of inappropriate behavior. Such cases not only demolish the reputation of the accused but also drag the organization along, tarnishing its brand image badly. As the responsibility of providing a safe and healthy workplace to every female lies on the employers and managements, by providing training at regular intervals they can create awareness and achieve this.

What does “Sexual Harassment” include?

According to the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, “Sexual Harassment” includes varied unwelcome behavior, whether directly or by implication. For example:
